  • The person must be under 45 years of age when invited for the visa. However, you are still eligible for a visa if you turn 45 years old after the Department of Home Affairs has invited you to apply.
  • You must score 65 or more points in the skilled migration points test.
  • The occupation you are applying for must be on the Occupations list (MLTSSL) for Skilled Independent Visa Australia (subclass 189 visa Australia).

New Zealand Stream

Under a 189 visa Australia New Zealand Stream, eligible New Zealand citizens who have demonstrated contribution and commitment to Australia can live and work in Australia permanently.

  • An individual must satisfy the income requirements. Moreover, their taxable income, as shown in ATO's Notice of Assessment, must be at least the minimum income threshold. In certain cases, amounts below the threshold are accepted, but you have to show evidence of an exemption in such cases.
  • The applicant must have been usually a resident of Australia for a continuous time period of at least five years immediately before the 189 visa Australia application date. In addition, this continuous period of usual residence in Australia must have begun on or before February 19, 2016.
  • The applicant must hold a New Zealand Special Category visa (subclass 444) for their subclass 189 visa Australia application to be processed. To get their visa application processed, members of their family must hold any of the following visas when they file their application:
    1. A substantive visa
    2. Subclass 020 Bridging B visa
    3. Subclass 010 Bridging A visa

Hong Kong Stream

Under a 189 visa Australia Hong Kong Stream, eligible Hong Kong or British National (Overseas) passport holders who have demonstrated commitment to Australia can permanently live and work in Australia.

  • The individual must hold an eligible visa (subclass 457, 482, or 485) when their 189 visa Australia application is made. In addition, they must have held that visa for at least four years before that date. If they were granted an eligible visa before July 9, 2020, their visa must not expire after July 8, 2025. If a person was granted a visa on or after July 9, 2020, their visa must be valid for five years.
  • When the subclass 189 visa Australia application is made, the individual must hold a Hong Kong or British National (Overseas) passport.
  • The individual must have been usually resident in Australia for a continuous time period of at least four years immediately prior to the date of their application.
  • The person must have complied with the conditions attached to their eligible visa in Australia for the whole period they held the visa(s).
  • When the DHA decides on your application at that time, you must have functional English or pay the second instalment of the 189 visa Australia application charge when DHA asks for it.

English language

The applicant must have Competent English or better. They must either provide evidence of their English language skills when they apply for the 189 visa Australia or show that they hold a valid passport from the UK, USA, Canada, New Zealand or the Republic of Ireland.
