What are the eligibility requirements for a Contributory Aged Parent 864 visa?

 

Sponsor

An eligible sponsor must sponsor the applicant. Usually, the applicant must be sponsored by an eligible child. However, if the child is under 18, then an eligible relative or community organisation can sponsor the applicant. In all cases, the Department of Home Affairs must approve your sponsorship. If a person holds a Temporary Contributory Aged Parent visa subclass 884 and your sponsor dies, you might still be eligible for a Contributory Aged Parent (subclass 864) visa. 

Visa requirement

A person cannot apply for a Contributory Aged Parent 864 visa if they have already applied for or are holding a Sponsored Parent (temporary) visa subclass 870. 

Age requirements

To be eligible to apply for a contributory parent visa 864, the applicant must be old enough so that they are eligible to receive the age pension in Australia.  

Meet the balance-of-family test

The applicant must meet the balance-of-family test. A person can meet the balance-of-family test for a contributory parent visa if at least half of their children and step-children are eligible or if the person has more eligible children who live in Australia in comparison to any other single country. However, the applicant has already met the balance of family test if they hold a Contributory Aged Parent (temporary) visa subclass 884.  

Character requirement

The applicant and their family members who are applying for contributory parent visa 864 must meet the Australian government's character requirements. The Department of Home Affairs might also ask family members who have not applied for the visa to meet the character requirements. 

Meet the health requirements

The applicant and any family members who are applying for an aged parent visa 864 must meet the health requirements laid down by the Australian government. The non-migrating members might also be asked to meet the health requirements. 

Assurance of support

The applicant must be able to obtain an assurance of support as it assures the Department of Home Affairs that the applicant will not have to rely on government assistance when they enter Australia on a Contributory Parent visa 864. The assurance of support is needed for the applicant and the family members who are entering Australia on an aged parent visa subclass 864. 

Previous visa cancellations and refusals

The applicant must not have had a visa cancelled before, or a previous application refused.

If the applicant or any of their family members owe the Australian government any money, they must have paid it back or should have a formal arrangement to pay it back.

Best interests of the child

The Contributory Parent visa 864 might not be granted to an applicant under 18 if it is not in their best interests. 

Acceptance of Australian Values Statement

If the applicant is 18 years or older, they must sign the Australian Values Statement.
