What are the eligibility requirements for a Parent Visa 103?

 

Sponsor

An eligible sponsor must sponsor the person applying for a Parent Visa 103. 

Usually, an eligible child sponsors the applicant. In case the child is under 18, then an applicant can be sponsored by either an eligible relative or community organisation. The Department of Home Affairs must approve your sponsorship. However, if the person is applying as a retiree, then they don't need a sponsor. 

Visa requirements

A person cannot apply for Parent Visa 103 if they have already applied for or are holding a Sponsored Parent (Temporary) visa subclass 870.

Apply as a retiree

A person can apply as a retiree for Parent Visa 103 if the person has not held any other substantive visa between May 8, 2018 and the date the person applied for the parent visa, and if on May 8, 2018, the person held or had previously held either an Investor Retirement visa subclass 405 or Retirement subclass 410. If a person is applying for the Parent Visa 103 as a retiree, then they are not required to meet the balance-of-family test. The person also does not need an assurance of support and a sponsor.

Meet the balance-of-family test

The applicant must meet the balance-of-family test. The person meets this test if at least half of their children and step-children are eligible children or if they have more eligible children who live in Australia in comparison to any other single country. If a person is applying as a retiree, then they don't have to meet the balance-of-family test. 

Assurance of support

The applicant must be able to obtain an assurance of support as it assures the Department of Home Affairs that the applicant will not have to rely on government assistance when they enter Australia on a Parent Visa 103. The assurance of support is needed for the applicant and the family members who are entering Australia on a Parent Visa 103. However, if a person is applying as a retiree, then they don't need assurance of support.

Meet the health requirements

The applicant and any family members who are applying for a Parent Visa 103 must meet the health requirements laid down by the Australian government. The non-migrating members might also be asked to meet the health requirements.

Character requirement

The applicant and their family members who are applying for Parent Visa 103 must meet the Australian government's character requirements. The Department of Home Affairs might also ask family members who have not applied for Parent Visa 103 to meet the character requirements. 

Paid back to the Australian government

If the applicant or any of their family members owe the Australian government any money, they must have paid it back or should have a formal arrangement to pay it back.

Previous visa cancellations and refusals

The applicant must not have had a visa cancelled before or a previous application refused.

Acceptance of Australian Values Statement

If the applicant is 18 years or older, they must sign the Australian values statement.

Best interests of the child

The Parent Visa 103 might only be granted to an applicant under 18 if it is in their best interests.

Have health insurance

The person should have health insurance as they are personally liable for all their healthcare costs while they are in Australia. If the person is applying for a Parent Visa 103 as a retiree, they must maintain adequate health insurance until the applicant is granted a Parent Visa 103.

How to apply a Parent Visa 103?

The visa applicant must meet the eligibility criteria to apply for Parent Visa 103. The person and the family members who are applying for a Parent Visa 103 can be in or outside Australia; however, they must not be in immigration clearance. Any family members included in this visa application must also be in the same country as the main applicant when applying for this visa. In case a person is applying as a retiree, then they must be in Australia but should not be in immigration clearance when they apply. However, the retiree can be in or outside Australia when their application is decided upon. After the grant of the Parent Visa 103, a person can travel to and from Australia multiple times for five years. A person can also include family members in their application when applying.
