The applicant must begin their employment within 90 days of entering Australia if they are outside Australia when the visa 494 is granted or the visa grant date if the applicant is in Australia at the visa grant time.

Labour Agreement Stream

What are the eligibility criteria for a Skilled Employer Sponsored Regional visa 494?

 

Age requirements

The applicant must be under 45 years of age when they apply for visa 494 Australia. However, you may be exempt from the age criteria if the labour agreement states otherwise.

Nominated by an approved sponsor

The applicant must be nominated by an employer operating a business according to Australian laws to be eligible for an Employer Sponsored stream Visa 494 Australia. Moreover, the applicant must work in the nominated occupation and at a position either within a sponsoring business or an associated business entity located in a designated regional area of Australia.

Work under a labour agreement

If the applicant is applying under the Labour Agreement stream, they must work under a labour agreement. The occupation they have been nominated for must be part of a labour agreement between the nominator and the Commonwealth.

Primary SESR visa holder as a family member

If a person is applying for a Visa 494 Australia under the Subsequent Entrant stream, then they must have a family member who is either the main applicant of a SESR visa or a primary SESR visa holder to be able to file a subsequent entrant visa 494 Australia application. 

Be nominated by the work sponsor of the primary SESR visa holder

The employer of the main applicant of the SESR visa or primary SESR visa holder must agree in writing to include the Subsequent Entrant applicant as a family member in the nomination.

English language requirement

Applicants applying under the Employer Sponsored stream must have at least competent English. The Labour Agreement stream applicant must have the level of English as set out in the labour agreement. However, Subsequent Entrant stream applicants must have functional English; if they can't show that they have Functional English, they need to pay the second instalment.

Health requirements

The Visa 494 applicant and any family member who applies, along with the applicant, must meet the health requirements. The Department of Home Affairs might also ask other family members who have not applied for the Skilled Employer Sponsored Regional Provisional Visa 494 to meet the health requirements.

Character requirement

The applicant and any family member who is applying for the Visa 494 Australia, along with the applicant, must meet the character requirements. Paid back to the Australian government

If the applicant or any of their family members owe the Australian government any money, they must have paid it back or should have a formal arrangement to pay it back.

If the applicant is 18 years or older, they must sign the Australian values statement.
